Plain-Language Terms Your Local Consumer Rights Preserved

1. Agreement to These Terms

These Terms of Use (the "Terms") govern your use of https://www.hemasai.com (the "Site"), operated by Hema Sai Mallampati, an individual based in Dallas, Texas, United States ("we", "us"). By using the Site you agree to these Terms, and when you send a form you confirm that agreement expressly, including the arbitration agreement in section 12. If you do not agree, please do not use the Site. Our Privacy Policy and Cookie Policy explain how personal data is handled and form part of these Terms.

2. Who May Use the Site

The Site is a personal professional portfolio. Anyone may read it, but its forms are for adults (18 or over). It is offered only in India, the United Arab Emirates, Qatar, Canada, the United States, Australia, and is not available elsewhere. We may change, suspend or withdraw any part of the Site at any time and do not promise that it will be available without interruption.

3. Acceptable Use

You agree not to:

  • use the Site in breach of any applicable law or regulation;
  • attempt to gain unauthorised access to the Site, its administration area, its servers or its data, or to test its security other than as permitted by our Vulnerability Disclosure Policy;
  • interfere with the Site's operation, including by denial-of-service attacks or excessive automated requests;
  • circumvent the Site's country restrictions, rate limits or other technical controls;
  • submit content that is unlawful, misleading, infringing, or that contains malware;
  • submit another person's personal data without their authority, or impersonate anyone;
  • scrape or copy the Site's content in bulk except as allowed by section 4.

4. Intellectual Property

The text, articles, case studies, resources, designs, graphics and other original content on the Site, and the Site's arrangement, are created by Hema Sai Mallampati independently, in a personal capacity and with personal resources. Unless stated otherwise, they are owned by him and protected by copyright and other intellectual property laws. You may view, print and share links to pages for your personal or internal professional use, and quote short extracts with attribution and a link to the source page. Any other copying, republication, modification or commercial use needs our prior written permission.

Names of organisations, products and trademarks belong to their owners and are used only to describe professional history or to identify them; no affiliation, sponsorship or endorsement is implied. Open-source software used by the Site is licensed under its own terms, listed on the Open Source Licenses page.

5. Downloadable Resources

Whitepapers, guides and other resources are provided for your personal or internal evaluation. You may not resell, redistribute or publish them without permission. Download links are personal to you and expire shortly after they are issued.

6. What You Send Us

When you contact us or request a resource, you confirm that the details you give are accurate and yours to give. Do not send confidential, proprietary or sensitive information. Contacting us does not create a client, employment, confidentiality or advisory relationship, and we are not obliged to reply.

7. Personal Capacity and No Professional Advice

The Site is a personal, independent website, shared for knowledge-sharing purposes. It is not operated, sponsored, reviewed or endorsed by any current or former employer or client, and the views expressed are the author’s own. Content is drawn from publicly available information and general professional experience; it does not include confidential or proprietary information of any employer or client. Figures describing past work are approximate, résumé-level summaries.

Content on the Site, including architectures, code samples, opinions and the chat assistant’s answers, is general information. It is not legal, security, financial, compliance or other professional advice, and you should not rely on it as such. Assess any approach against your own circumstances and obtain qualified advice before acting on it.

8. Links and Third-Party Services

The Site links to other websites and, if you ask for a translation, uses Google Translate. We do not control those services and are not responsible for their content, availability or privacy practices; your use of them is governed by their own terms. Machine translations may be inaccurate, and the English text of every page is the authoritative version.

9. Disclaimer

To the extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, fitness for a particular purpose and non-infringement. We work to keep the content accurate and current but do not promise that it is.

10. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, the Site or its content. The Site is provided free of charge, and to the extent permitted by law our total liability to you for any claim relating to it is limited to one hundred US dollars (US$100).

Your statutory rights are not affected. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, for death or personal injury caused by negligence, or under the consumer guarantees of the Australian Consumer Law or any other mandatory consumer protection law of your country.

11. Responsibility for Misuse

To the extent permitted by law, you are responsible for, and will compensate us for, reasonable losses and costs arising from your breach of section 3 or your unlawful use of the Site.

12. Governing Law and Dispute Resolution

Please read this section carefully: it requires most disputes to be resolved by individual arbitration in Dallas, Texas, instead of in court, and it waives class actions and jury trials.

  1. Governing law. These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. The Federal Arbitration Act governs this section 12.
  2. Try to resolve it first. Before starting any claim, send a written description of the dispute and the outcome you want to hemasaimallampati@outlook.com. Both of us will try in good faith to resolve it within 60 days, and neither may start arbitration or a claim until that period ends.
  3. Binding individual arbitration. Any dispute, claim or controversy arising out of or relating to the Site or these Terms that is not resolved informally will be finally resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Dallas, Texas, United States. The arbitrator may decide on documents or hold hearings by video; any in-person hearing will take place in Dallas County, Texas. Fees are paid as those Rules provide. Judgment on the award may be entered in any court with jurisdiction.
  4. Individual claims only. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of different people. Both of us waive any right to a jury trial.
  5. Exceptions. Either of us may bring an individual claim in a small-claims court that has jurisdiction over it. We may also ask the state or federal courts located in Dallas County, Texas, for an injunction to stop unauthorised access, attacks on the Site, or infringement of our intellectual property.
  6. Your mandatory rights. If you live where the law does not allow consumers to agree in advance to arbitration, or to give up access to the courts or a consumer body (for example Quebec or Ontario in Canada, consumer commissions in India, or the Australian Consumer Law), this section applies to you only as far as that law allows, and you may bring your claim in the courts or bodies that law provides. Nothing in these Terms removes rights that cannot be excluded by agreement.
  7. If part of this section fails. If the class-action waiver is found unenforceable for a claim, that claim will proceed in the state or federal courts located in Dallas County, Texas, and not in arbitration. Any other matter that is not subject to arbitration will be decided by those courts, and both of us consent to their jurisdiction.

13. Changes and General Terms

  • We may update these Terms; the date at the top shows the latest version, which applies from that date.
  • If any provision is found unenforceable, the rest of these Terms remain in effect.
  • A failure to enforce any provision is not a waiver of it.
  • These Terms, with the Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Site.
